Private international law is becoming increasingly important and complex in practice. Globalization, in its many forms, has exposed numerous problems, with technological developments, in particular global communications, and the increasing sophistication of international trade and finance, giving rise to novel concerns for practitioners. As private international law becomes more compartmentalized and specialized it is more difficult to discern the subject's structure and assumptions. The book offers an account of the subject which is comprehensive, yet also concise and highly focused, designed to reflect the perceptions and concerns of practitioners. It covers both civil and commercial matters, and also considers family law and personal status. Particular weight is given to evolving areas of practice, such as the regulation of multinational corporations and the problems associated with electronic commerce, with emphasis on the solution of current (or future) problems, in addition to explaining contested issues. It is as much concerned with prospective planning and risk-avoidance, as with the adjudication of international disputes. There is also coverage of the scope of party choice, and the legal risks associated with cross-border business. Suggestions are given as to how these risks might be avoided or reduced by planning or agreement, adopting particular business structures, or by opting for alternative forms of dispute resolution.
